Anti-spam policy
Appendix No. 1 to the License Agreement for the Right to Use the EmailMassivo Service
By registering in the Service, the User accepts the terms of this Anti-SPAM Policy.
1. Key Terms
1.1. Service – the EmailMassivo service intended for creating, sending and monitoring the results of sending electronic mail to Subscribers subject to their mandatory prior consent. Sending unsolicited messages using the Service is strictly prohibited.
1.2. Spam – messages transmitted via telecommunications channels, the requirements of which do not comply with applicable law.
1.3. Subscriber – natural or legal persons who have given explicit consent to receive informational mailings from the User and are included in the User's customer database for the purpose of receiving messages.
1.4. Subscription form - a functional block placed on a website that contains fields for entering information (name, email address, contact phone number, etc.). The main purpose of the subscription form is to collect personal contact information of users who have expressed a wish to receive the mailing.
1.5. Spam complaint – one of the following events: a) notification from a Subscriber or from an anti-spam organization about receipt of unsolicited correspondence by their users; b) blocking of the User's mail servers and URLs on major Internet resources; c) receipt of a spam complaint from a mail server.
2. General Provisions
2.1. The User is prohibited from sending mailings of messages that do not comply with applicable law or the law of the Subscriber's country, including mailings containing:
- spam in any form and manifestation;
- inaccurate information;
- obscene language;
- malicious and unlicensed software;
- incitement to racial, religious or gender discrimination;
- copyrighted material and third-party trademarks used without the rights holder's permission;
- pornographic material;
- the sending of email messages that contain in the header and/or in the body of the message offers of quick and easy earnings on the Internet, quick and easy money or pyramid schemes.
The personal account of Users found to be distributing spam is blocked.
2.2. Each message sent through the Service must mandatorily include a link by which the Subscriber can unsubscribe from the User's mailings. The User has no right to hide or mask this link.
2.3. The User is prohibited from sending mailings to their subscriber database that are ordered by third parties for the purpose of advertising their product.
2.4. The User agrees that certain mailings, in particular, but not limited to, cases where the content of the mailing does not meet the requirements established by this Anti-SPAM Policy or applicable law, or contains indications that Subscribers did not consent to receiving such mailing, may be blocked by the Software or by the Service's staff.
3. Cases in Which Messages Are Interpreted as SPAM
3.1. Targeted information is sent to purchased or publicly available email lists without sending a prior email to obtain consent to the mailing.
3.2. In the overwhelming majority of cases, messages are sent to mailboxes such as info@, sales@ and other generic email mailboxes.
3.3. Incorrect or distorted contact details are indicated.
3.4. The subject and text of the message contain false, incorrect or misleading information.
3.5. An email address is used that does not belong to the domain associated with the company.
3.6. The body of the email does not contain an "unsubscribe from the mailing list" link.
3.7. For a long period of time after receipt of a request to unsubscribe from the mailing, the unsubscribe is not executed.
3.8. In mailing reports, the rates of clicks on the "spam" button or blocking of messages by email providers' spam filters or the number of bounces significantly exceed the average values for the Service **(hard bounces no more than 5%, "this is spam" clicks - 0.5%)**.
3.9. The User's actions and/or the content of the mailing are contrary to applicable law.
4. Grounds for Contacting the Recipient
The email recipient made a purchase, requested information, responded to questions/surveys, is a client of the User, contacted the User offline, filled out a subscription form, or responded positively to a prior email requesting consent to receive the mailing. At the same time, the email recipient received a clear understanding of the purpose for which the email address requested would be used.
5. Preventive Methods of Combating SPAM
5.1. Mandatory pre-moderation of all mailings.
5.2. Automated analytical systems for recognizing SPAM.
5.3. Verification of User data in order to prevent access to the system being obtained for the purpose of unlawful use.
5.4. Ongoing training and consulting of Users for the purpose of creating proper email marketing campaigns.
5.5. Ongoing cooperation with Internet and hosting providers in order to ensure that the operation of the Service is interpreted as a lawful method of conducting marketing activities and sales.
5.6. Blocking of Users who use the Service for sending SPAM. In the absence of weighty arguments on the part of the User within 24 hours from the moment of blocking, the account is subject to deletion without the possibility of refund of unused funds.
6. Mailing Lists Permitted and Prohibited for Use in the Service
6.1 Use of a mailing list is permitted if the email addresses it contains were obtained in one of the following ways:
6.1.1. On the User's website via a subscription form.
6.1.2. On the User's website via any other form (for example, during user registration), subject to the mandatory condition that the form contained a separate checkbox for consenting to receive mailings to the email address provided.
6.1.3. Via paper questionnaires, forms, surveys that the recipient filled in by hand and entered their email address, subject to the mandatory condition that the form contained a separate checkbox for consenting to receive mailings to the email address provided.
6.1.4 From among the User's current clients after the User has sent them a request for consent to receive mailings and has received a positive response.
6.2 Use of a mailing list is not permitted if:
6.2.1. The User cannot prove the recipients' consent to receive the mailing.
6.2.2. The User obtained addresses by means of verbal consent, for example, via a phone call.
6.2.3. The User acquired, leased or received addresses from third parties.
6.2.4. Address databases are collected from "open sources".
